Welcome to Poemmart. These Terms of Service ("Terms") govern your access to and use of poemmart.com, our products, personalization features, and related services (collectively, the "Services").

Throughout these Terms, "Poemmart," "we," "us," and "our" refer to Poemmart. "You" and "your" refer to any visitor, customer, or other person who accesses or uses our Services.

Please read these Terms carefully before using our Services or placing an order. By accessing our Site, placing an order, or otherwise using the Services, you agree to be bound by these Terms and the policies referenced in them.

If you do not agree with these Terms, you should not use the Services.

1. Eligibility

By placing an order or using our Services, you represent that you are legally capable of entering into a binding agreement in your jurisdiction or that you are using the Services with the authorization and supervision of a parent or legal guardian where permitted by applicable law.

You may not use our Services for any unlawful or unauthorized purpose.

2. Use of the Site

You agree to use our Site and Services only for lawful purposes and in accordance with these Terms.

You must not:

  • Use the Site in violation of applicable laws or regulations.
  • Attempt to gain unauthorized access to our Site, servers, accounts, systems, or networks.
  • Interfere with or disrupt the security, operation, or functionality of the Services.
  • Introduce viruses, malicious code, automated attacks, or other harmful technologies.
  • Use automated tools to scrape, copy, harvest, or extract Site content in a manner that violates applicable law or our rights.
  • Impersonate another person or provide materially false information.
  • Use our Services to facilitate fraud, abuse, infringement, or other unlawful activity.

We may restrict or terminate access to the Services when reasonably necessary to protect our customers, business, systems, or legal rights.

3. Products and Made-to-Order Nature

Poemmart specializes in personalized blankets and other made-to-order products offered through our Site.

Our products are generally manufactured after an order is submitted rather than being taken from finished retail inventory.

Because products are made to order and many are personalized specifically for an individual customer, certain cancellation, return, exchange, refund, and replacement rules differ from those that may apply to ready-made, non-personalized retail products.

Please review our Return & Refund Policy before placing an order.

4. Personalized Products

Depending on the selected product, you may be able to personalize your order using:

  • Names.
  • Photos or images.
  • Dates.
  • Messages or quotes.
  • Custom text.
  • Design options.
  • Colors or styles.
  • Other personalization details made available on the applicable product page.

Personalized products are created based on the information and content submitted with your order.

You are responsible for reviewing your personalization information carefully before completing your purchase.

5. Customer-Submitted Content

"Customer-Submitted Content" includes photos, images, names, text, messages, graphics, designs, or other materials that you upload, submit, provide, or otherwise make available to Poemmart for use in connection with an order or the Services.

You retain any ownership rights you lawfully hold in your Customer-Submitted Content.

By submitting Customer-Submitted Content, you grant Poemmart and the service providers acting on our behalf a limited, non-exclusive license to use, reproduce, resize, crop, modify, process, transmit, store, print, and otherwise handle that content only as reasonably necessary to:

  • Prepare your personalization.
  • Create your requested product.
  • Process and fulfill your order.
  • Perform quality control.
  • Provide customer support.
  • Investigate production or fulfillment issues.
  • Produce an approved replacement or reprint.
  • Resolve an order-related claim or dispute.
  • Comply with applicable legal obligations.

This limited license does not transfer ownership of your Customer-Submitted Content to Poemmart.

We do not use customer-submitted photos or personalization content in advertising or promotional materials without appropriate permission.

6. Your Rights and Responsibilities for Submitted Content

By submitting Customer-Submitted Content, you represent and warrant that you have the rights, permissions, licenses, consents, or other lawful authority necessary to provide and use that content for the personalized product you request.

You must not submit content that:

  • Infringes copyrights, trademarks, publicity rights, privacy rights, or other rights of another person or entity.
  • Is unlawful, fraudulent, threatening, abusive, or defamatory.
  • Contains unlawful sexually exploitative material.
  • Violates another person's privacy or confidentiality rights.
  • Is otherwise prohibited by applicable law.

If your submitted content includes another person's photograph, name, likeness, or other personal information, you are responsible for having the appropriate authority or permission to use that content for the requested personalized product.

We reserve the right to refuse, suspend, or cancel an order containing content that we reasonably believe may violate these Terms, applicable law, or third-party rights.

If we cancel an order for this reason before production is completed, any refund or other resolution will be determined based on the circumstances, applicable law, and our policies.

7. Automated and AI-Assisted Image Processing

Certain personalized designs may use automated or AI-assisted technologies to prepare customer-uploaded images for production.

Depending on the product or design selected, submitted images may be:

  • Cropped or resized.
  • Repositioned.
  • Adjusted to fit a personalization template.
  • Processed to remove or modify a background.
  • Converted to grayscale or another design treatment.
  • Adjusted as reasonably necessary to prepare the image for printing or manufacturing.

These processes are used to create the personalized product selected by the customer and do not transfer ownership of the submitted image to Poemmart.

8. Personalization Accuracy

You are responsible for reviewing all personalization information before submitting your order, including:

  • Names and spelling.
  • Dates.
  • Messages and custom text.
  • Uploaded photos.
  • Selected product.
  • Size.
  • Color.
  • Style.
  • Quantity.
  • Other selected personalization options.

When a product is produced correctly according to the information, image, and options submitted with the order, a customer-submitted spelling error, incorrect date, unsuitable image, incorrect selection, or similar customer error is not considered a production defect.

If Poemmart, our production process, fulfillment provider, or shipping process causes an eligible error, the affected product may qualify for a Full Refund or Free Replacement under our Return & Refund Policy.

9. Product Images, Colors, and Production Variations

We make reasonable efforts to display product images, colors, designs, and personalization previews accurately.

However, the appearance of colors may vary depending on your screen, device, display settings, uploaded image quality, printing method, fabric, material, product size, and manufacturing process.

Because products are individually manufactured, minor reasonable variations in print positioning, color appearance, stitching, dimensions, or other production characteristics may occur.

Minor reasonable production variations that do not materially affect the intended product are not necessarily considered defects.

Nothing in this section limits your rights when a product is materially damaged, defective, incorrect, or improperly produced and otherwise qualifies for a remedy under our Return & Refund Policy or applicable law.

10. Product Information and Availability

We make reasonable efforts to ensure that product descriptions, images, personalization options, pricing, and availability displayed on our Site are accurate.

However, products, features, colors, sizes, production options, shipping methods, or other offerings may be changed, discontinued, or become unavailable.

All orders are subject to acceptance, availability, production capability, and applicable order verification.

11. Orders and Order Acceptance

Submitting an order does not require Poemmart to accept or fulfill an order that cannot reasonably or lawfully be processed.

We may refuse or cancel an order when reasonably necessary, including because of:

  • Product or production unavailability.
  • Payment failure or payment verification issues.
  • Suspected fraud or unauthorized transactions.
  • Incorrect pricing or material website errors.
  • An invalid or incomplete shipping address.
  • Customer-Submitted Content that may violate applicable law or third-party rights.
  • Technical or fulfillment issues that prevent us from completing the order.

If we cancel an order that has already been paid and no other payment obligation applies, we will refund the applicable amount collected for the canceled item or order.

12. Pricing

Product prices are displayed on our Site and may change from time to time.

Unless otherwise stated, a price change does not retroactively change the price of an order that has already been completed and accepted.

We reserve the right to correct typographical, technical, or pricing errors.

If a material pricing error affects an order you have already submitted, we may contact you for instructions or cancel the affected order and refund the applicable amount paid. We will not charge a higher corrected price without your authorization.

Discounts, promotional offers, and coupon codes may be subject to additional terms, expiration dates, product restrictions, minimum order requirements, or other conditions disclosed with the applicable promotion.

13. Payment

Available payment methods are displayed during checkout and may vary depending on your location, device, currency, or other factors.

You agree to provide current, complete, and accurate purchase and payment information when placing an order.

Payments may be processed through Shopify and/or authorized third-party payment providers.

You authorize the applicable payment provider to charge the amount shown at checkout, including the product price, applicable shipping charges, taxes, Rush Production fees or other optional service charges when selected, and any other charges clearly disclosed before purchase.

Poemmart does not guarantee the availability of any specific payment method.

14. Taxes, Duties, and Other Charges

Applicable sales taxes or similar taxes may be calculated and collected during checkout where required.

International orders may also be subject to customs duties, import taxes, brokerage charges, or other fees imposed by the destination country, applicable government authority, or carrier.

15. Shipping and Delivery

Because our products are made to order, delivery time consists of both Production Time and Shipping Transit Time.

Production and shipping estimates vary depending on product type, destination, shipping method, and whether an eligible Rush Production option is selected.

Available shipping methods, applicable shipping charges, production estimates, order cut-off information, and delivery estimates are described in our Shipping Policy and, where applicable, during checkout.

Unless a service is expressly identified as guaranteed, production and delivery dates are estimates and may be affected by carrier delays, weather, customs, peak seasons, production issues, incorrect addresses, or circumstances outside our reasonable control.

Shipping transit time begins only after production has been completed and the applicable package has been handed over to the carrier.

16. Rush Production

Eligible products may offer an optional Rush Production service for an additional fee.

Rush Production accelerates production only and does not automatically upgrade the shipping method selected for an order.

Availability, applicable Rush Production timeframes, fees, daily order cut-off information, and related conditions are described in our Shipping Policy and/or displayed during checkout.

Rush Production and expedited shipping are separate services.

17. Order Cancellations and Changes

Because our products are made to order, production may begin shortly after an order is placed.

You may request to cancel an order or change personalization or shipping information within 5 hours of purchase.

We will make reasonable efforts to accommodate eligible requests, but cancellation or modification cannot be guaranteed if the order has already entered production, fulfillment, or shipping.

After production has begun, customer-requested cancellations or changes may not qualify for a refund.

18. Returns, Refunds, and Replacements

Because Poemmart products are made to order and many are personalized specifically for each customer, we do not offer a general return, exchange, or refund window for buyer's remorse, changes of mind, or customer errors when a product has been produced correctly according to the submitted order.

Our 14-day claim period is not a general 14-day return period.

If there is an eligible product, production, fulfillment, or shipping issue, you should contact us within 14 days of receiving your order.

Eligible issues may include circumstances such as:

  • A damaged product.
  • A defective product.
  • An incorrect item.
  • An item produced incorrectly compared with the submitted order.
  • An eligible shipping or fulfillment problem.

Approved eligible claims may qualify for a Full Refund or Free Replacement.

A Full Refund generally means a refund of 100% of the amount paid for the affected item, subject to the terms of our Return & Refund Policy.

Approved damaged, defective, incorrect, or incorrectly produced products generally do not need to be returned unless Poemmart specifically instructs otherwise.

Customer errors, including incorrect names, dates, text, photos, sizes, colors, product options, shipping information, or other selections submitted by the customer, generally do not qualify for a Full Refund or Free Replacement when the product has been correctly produced according to the submitted order.

19. Intellectual Property

The Site and Poemmart-owned or Poemmart-licensed content available through the Site, including applicable logos, branding, graphics, designs, text, website layout, product presentation, and other materials, are owned by or licensed to Poemmart and may be protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, republish, commercially exploit, or otherwise use protected Poemmart content without our prior authorization except as permitted by applicable law.

Third-party names, trademarks, graphics, software, or other materials displayed through the Services remain the property of their respective owners where applicable.

Nothing in this section gives Poemmart ownership of Customer-Submitted Content merely because you submit it for use in creating a personalized order.

20. Reviews and Feedback

We respect customers' rights to provide honest reviews, opinions, and feedback about our products and Services.

Nothing in these Terms is intended to prevent or penalize you for providing an honest review or expressing a lawful opinion about Poemmart, our products, or our Services.

If you voluntarily submit a review, comment, testimonial, suggestion, or other feedback directly through a feature intended for public reviews or feedback, you grant us permission to display and use that submission for the purpose for which it was provided, subject to applicable law and our Privacy Policy.

We may moderate content that contains unlawful material, spam, confidential information, personal information posted without authorization, threats, harassment, or content unrelated to a genuine customer experience.

21. Privacy

Your privacy is important to us.

Our collection, use, disclosure, processing, and retention of personal information are described in our Privacy Policy.

Customer-uploaded photos, personalization information, payment-related information, cookies, analytics, advertising technologies, and privacy rights are addressed in greater detail in that policy.

22. Third-Party Services and Links

Our Services may rely on or contain links to third-party platforms, payment providers, fulfillment services, carriers, analytics providers, social networks, or other websites and services.

Third-party services may be governed by their own terms, policies, and privacy practices.

We do not control third-party websites or services and are not responsible for their independent content, availability, privacy practices, or conduct, except to the extent responsibility cannot lawfully be excluded.

23. Service Availability

We make reasonable efforts to maintain the availability and functionality of our Site and Services.

However, the Site may occasionally be unavailable or interrupted because of maintenance, upgrades, technical failures, security issues, third-party service interruptions, or circumstances outside our reasonable control.

We may modify or discontinue Site features when reasonably necessary, subject to applicable law and our obligations concerning existing orders.

24. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Site and its general informational and technological features are provided on an "as available" basis.

We do not guarantee that the Site will always operate without interruptions, delays, errors, or security incidents.

This section does not limit any express product remedy stated in our Return & Refund Policy, any written commitment we expressly make regarding an order, or any warranty, remedy, or consumer right that cannot lawfully be excluded or limited.

25. Limitation of Liability

To the fullest extent permitted by applicable law, Poemmart and its officers, employees, affiliates, agents, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to your use of the Services or purchase of products where such damages may lawfully be excluded.

To the fullest extent permitted by applicable law, Poemmart's aggregate liability for a claim arising directly from an affected order will not exceed the amount you paid to Poemmart for the product or products giving rise to that claim.

Nothing in these Terms excludes or limits liability, remedies, warranties, or consumer rights that cannot lawfully be excluded or limited.

This limitation does not apply to the extent a limitation is prohibited by applicable law.

26. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Poemmart and its affiliates, officers, employees, agents, and service providers from third-party claims, liabilities, damages, losses, and reasonable costs arising from:

  • Your material breach of these Terms.
  • Your unlawful or fraudulent use of the Services.
  • Customer-Submitted Content that you did not have the legal right or permission to use.
  • Your infringement or violation of another person's intellectual property, privacy, publicity, or other legal rights.

This section does not require you to indemnify Poemmart for claims caused solely by Poemmart's own unlawful conduct where such indemnification is prohibited by law.

27. Events Outside Our Reasonable Control

We are not responsible for delays or failure to perform caused by circumstances outside our reasonable control, including severe weather, natural disasters, carrier disruptions, labor disruptions, government actions, customs delays, power or internet outages, major technology failures, epidemics, pandemics, civil disturbances, or similar events.

When such an event affects an existing order, we will make reasonable efforts to communicate available information and provide appropriate assistance.

This section does not eliminate any refund, replacement, or consumer remedy that is required by applicable law.

28. Governing Law

These Terms and your use of the Services are governed by the laws applicable in the State of Colorado, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws or other applicable laws require otherwise.

Subject to applicable law, disputes relating to these Terms or our Services may be brought before courts of competent jurisdiction in Colorado.

If you are a consumer residing in another state, country, or jurisdiction, nothing in these Terms deprives you of mandatory consumer rights or protections that apply to you and cannot lawfully be waived by contract.

29. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or, where appropriate, severed from these Terms.

The remaining provisions will continue in effect to the extent permitted by applicable law.

30. No Waiver

If Poemmart does not immediately enforce a provision of these Terms, that does not constitute a waiver of our right to enforce that provision later.

A waiver is effective only to the extent expressly provided.

31. Entire Agreement and Related Policies

These Terms, together with the policies and information incorporated by reference, form the agreement between you and Poemmart concerning the subject matter addressed in them.

If these Terms conflict with a more specific policy concerning its particular subject matter, the more specific policy will govern that subject matter to the extent of the conflict.

32. Assignment

You may not transfer your rights or obligations under these Terms to another person in a manner that materially affects Poemmart without our consent.

Poemmart may transfer its rights or obligations in connection with a merger, acquisition, corporate restructuring, sale of assets, or similar legitimate business transaction, subject to applicable law.

33. Changes to These Terms

We may update these Terms from time to time to reflect changes to our products, Services, business practices, technologies, policies, or legal requirements.

When these Terms are updated, we will revise the "Last Updated" date at the top of this page.

Material changes will be communicated as required by applicable law.

Changes to these Terms will not retroactively eliminate rights or remedies that apply to an order already placed where doing so is prohibited by applicable law.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
